These Terms & Conditions govern the provision of painting and decorating services by Chelsea Painters & Decorators ("we", "us", or "our") to you ("the client"). By engaging our services, you agree to be bound by these terms.
1. Quotations
All quotations are provided free of charge following an on-site survey or detailed discussion of your requirements. Quotations are valid for 30 days from the date of issue unless otherwise stated. Prices quoted are inclusive of labour, materials, and VAT where applicable.
Additional work not included in the original quotation will be discussed and agreed upon in writing before being carried out. Where unforeseen work is discovered during the project (for example, hidden damp or structural damage), we will notify you immediately and provide a revised quotation for the additional work.
2. Acceptance & Scheduling
A quotation is accepted when you confirm in writing (including email) that you wish to proceed. Once accepted, we will agree a start date and estimated project timeline. We make every effort to adhere to agreed schedules, but start dates may be subject to change due to weather conditions (for exterior work), preceding project overruns, or circumstances beyond our control.
3. Payment Terms
- Projects under £2,000: Full payment is due upon satisfactory completion of the work.
- Projects £2,000 – £10,000: A 30% deposit is required upon acceptance of the quotation, with the balance due upon completion.
- Projects over £10,000: A 25% deposit is required upon acceptance, with stage payments agreed in advance based on project milestones. The final 10% is due upon satisfactory completion.
Payment may be made by bank transfer, cheque, or card. Invoices are payable within 14 days of issue. Late payments may incur interest at 4% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
4. Access & Working Conditions
The client is responsible for providing clear and safe access to all areas to be painted or decorated. This includes moving furniture and personal items where necessary, or arranging for us to do so at an agreed additional cost. Where parking suspensions are required (for example, for scaffold erection), the cost will be included in the quotation.
5. Materials & Products
Unless otherwise specified, we supply all paint, materials, and sundries. Where specific products are requested by the client, we will source them on your behalf or accept client-supplied materials. We cannot guarantee the performance of client-supplied products.
6. Workmanship Guarantee
We guarantee all workmanship for a period of 2 years from the date of project completion. This guarantee covers defects arising from our workmanship, including peeling, flaking, or cracking that is not attributable to substrate failure, structural movement, or damage caused by the client or third parties.
Paint product guarantees are provided by the manufacturer and are separate from our workmanship guarantee. We will assist you in making any product guarantee claims where applicable.
7. Cancellation Policy
- Before work commences: You may cancel at any time before work begins. If materials have already been purchased, the cost of non-returnable materials will be charged.
- After work has commenced: You will be charged for all work completed to date, plus the cost of materials used or ordered, plus a cancellation fee of 15% of the remaining contract value.
- Cooling-off period: For contracts agreed at your home, you have a 14-day cooling-off period under the Consumer Contracts Regulations 2013, during which you may cancel without charge (provided work has not commenced at your request).
8. Liability
We carry comprehensive public liability insurance and employer liability insurance. We will make good any damage to your property caused directly by our work or negligence. Our liability is limited to the value of the contract unless otherwise agreed.
We are not liable for pre-existing defects, structural issues, or damage caused by third parties. Where we discover pre-existing issues that may affect the quality or longevity of our work, we will inform you and recommend appropriate remedial action before proceeding.
9. Health & Safety
We comply with all relevant health and safety legislation, including the Health and Safety at Work Act 1974 and the Construction (Design and Management) Regulations 2015 where applicable. Risk assessments are carried out for every project. We follow safe working practices for working at height, lead paint handling, and the use of chemical products.
10. Conservation & Listed Buildings
For properties within conservation areas or with listed building status, the client is responsible for obtaining any necessary planning consents or listed building consents before work begins. We can advise on requirements and assist with applications, but responsibility for securing consent rests with the property owner.
11. Complaints
We take every complaint seriously. If you are not satisfied with any aspect of our work, please contact us as soon as possible. We will arrange a site visit to inspect the concern and agree a resolution. If a resolution cannot be reached informally, we are willing to engage in mediation or alternative dispute resolution.
12. Force Majeure
We shall not be liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to severe weather, pandemic restrictions, supply chain disruptions, or government-imposed restrictions.
13. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
